  1. What is the Settlement About?

    The lawsuit claimed that RCI rented certain timeshare inventory deposited by Weeks members rather than make that inventory available for exchange in violation of consumer protection and other laws. RCI denies that it did anything wrong.


  2. Who is eligible for the settlement benefits?

    People who were members of the RCI Weeks Exchange Program at any time from January 1, 2000 through August 31, 2009 may be eligible for special settlement benefits. If you are or were a member of the RCI Points Exchange Program, but you were not also a member of the RCI Weeks Exchange Program at any time from January 1, 2000 through August 31, 2009, you are not a member of the Settlement Class.

    • Examples:
      I was a member of the RCI Weeks Exchange Program, but I subsequently converted my Vacation Time to RCI’s Points Exchange Program. Am I included in the settlement? Yes. If you were a member of the RCI Weeks Exchange Program at any time from January 1, 2000 through August 31, 2009, you are eligible for certain benefits as a Former Member.

      After becoming a member of the RCI Weeks Exchange Program, I purchased additional Vacation Time at a Points resort. Am I eligible for benefits? Yes. If you were are a member of the RCI Weeks Exchange Program as of August 31, 2009, you are a Member as defined in the Settlement Agreement, and you are eligible for benefits.

      Am I included if I am only a member of the RCI Points Exchange Program? No. If you are or were a member of the RCI Points Exchange Program, but you never were enrolled in the RCI Weeks Exchange Program, you are not eligible for any benefits under the settlement.

      I own Vacation Time at several different resorts, only one of which is affiliated with the RCI Weeks Exchange Program. Am I eligible for benefits? Yes. As long as you are or were enrolled in the RCI Weeks Exchange Program, you are eligible for benefits regardless of whether you also are or were enrolled in the RCI Points Exchange Program. Whether you are considered a Member or a Former Member will depend on whether you were enrolled in the RCI Weeks Exchange Program as of August 31, 2009.

      I belong to a vacation club that permits me to exchange in the RCI Weeks Exchange Program. Am I eligible? Yes. If you belonged to a vacation club whose members were enrolled in the RCI Weeks Exchange Program at any time between January 1, 2000 and August 31, 2009, then you may be eligible. The particular benefits for which you may be eligible will depend on whether you were enrolled in the Weeks Exchange Program as of August 31, 2009.


  3. What are the settlement benefits?

    If the Court approves the settlement and you do not exclude yourself, current members automatically get the benefit of the changes to RCI’s operation of the Weeks Exchange Program.

    In addition, eligible current members have their choice of one of five special benefits. A current member can choose: (1) the opportunity to search available inventory and make an exchange request prior to depositing your vacation time; (2) a $20 credit that can be used toward a membership renewal or toward your next exchange; (3) a prorated refund of your subscription fee and a refund of fees you’ve paid for a pending exchange requests, should you decide to end your Weeks Exchange Program membership; (4) one free night stay at any RCI rental that can be used toward the same room of any paid rental of at least one night; or (5) a $100 discount certificate per cabin for the purchase of any cruise offered by RCI, with the option of receiving additional $100 discount certificates toward the purchase of up to three additional cabins for the same cruise. Eligible former members can request to receive a $15 credit toward re-joining the Weeks Exchange Program or request a $15 payment from RCI.

  4. What do I have to do to get the special benefits?

    To get your choice of the special benefits available, you must submit a Claim Form. You can fill out and submit a claim form by clicking on the File Online Claim tab on this website. Or, you can mail your Claim Form to Rust Consulting, Inc., P.O. Box 1966, Faribault, MN 55021-6162. All Claim Forms must be submitted electronically or postmarked by November 20, 2009.

    Among other information, the Claim Form requires that you provide the name of the resort where your timeshare is located, the identification number associated with the resort where your timeshare is located, and your Weeks Exchange Program Identification Number.

    Resort Name: Resort Name is the name of the resort where your timeshare is located. You may find this information on your RCI Weeks Enrollment Application, Exchange confirmation acknowledgments, RCI Spacebank® acknowledgements, or an RCI Directory of Affiliated Resorts for Weeks. Please be advised that if you own or owned more than one timeshare, you may have multiple Resort Names, but you are required to submit the name of only one resort that is linked to your Weeks Exchange Program membership.

    Resort Identification Number: The Resort ID Number is the number associated with the resort where your timeshare is located. You may find this information on your RCI Weeks Enrollment Application, with your RCI Member Account Number. Your Resort ID Number may also be listed in an RCI Directory of Affiliated Resorts for Weeks with your Resort Name.

    RCI Weeks Exchange Program Identification Number: Your Weeks Exchange Program ID number is the number associated with your membership in the Weeks Exchange Program. You may find your ID number on your RCI ID membership card, on your Directory of Affiliated Resorts, on an Exchange confirmation acknowledgement, or on an RCI Spacebank® Deposit acknowledgement.


  5. How do I exclude myself from the settlement?

    To exclude yourself from the settlement, you must send a letter by mail saying that you want to be excluded from In re: Resort Condominiums International, LLC, Civil Action No. 06-1222 (PGS). Be sure to include your program identification number, your name, address and telephone number. You must mail your exclusion request postmarked no later than November 20, 2009 to:

  6. How do I object to the settlement?

    If you’re a Class member, you can object to the settlement if you don’t like any part of it. You can give reasons why you think the Court should not approve it. The Court will consider your views. To object, you must send a letter saying that you object to the settlement in In re: Resort Condominiums International, LLC, Civil Action No. 06-1222 (PGS). Be sure to include the class member’s name, address, telephone number, RCI Weeks Exchange Program Identification Number, Resort Identification Number, resort name and your signature, and the reasons you object to the settlement. Mail the objection to these places postmarked no later than November 20, 2009 to:

  7. What is the difference between objecting and excluding?

    Objecting is telling the Court that you don’t like something about the settlement. You can object only if you stay in the Class. Excluding yourself is telling the Court that you don’t want to be part of the Class. If you exclude yourself, you have no basis to object because the case no longer affects you.

  8. May I speak at the hearing?

    You may ask the Court for permission to speak at the Fairness Hearing. To do so, you must send a letter saying that it is your “Notice of Intention to Appear in In re: Resort Condominium International, LLC, Civil Action No. 06-1222 (PGS).” Be sure to include your name, address, telephone number, and your signature. Your notice of Intention to appear must be postmarked no later than November 20, 2009 and be sent to the Clerk of the Court, Co-Lead Class Counsel, and Defense Counsel, at the following addresses:

  9. What are the deadlines?

    • If you wish to exclude yourself from the Settlement, you must send in a written request for exclusion to the Co-Lead Class Counsel postmarked no later than November 20, 2009.

    • If you wish to object to the Settlement, you must send your objection to the Clerk of the Court, Co-Lead Class Counsel and Defense Counsel postmarked by November 20, 2009.

    • If you wish to appear at the Final Settlement Hearing, you must file a Notice of Intention to Appear with the Clerk of the Court, and serve the Notice on Co-Lead Class Counsel and Defense Counsel postmarked by November 20, 2009.

    • The final settlement hearing will be held November 30, 2009 at 2:30 pm.


    • If you wish to submit a claim, it must be submitted electronically or postmarked by November 20, 2009.
